Terms & Conditions (AGB)

Ease-Creative
Collective of Felix Seitlinger & Nickolaus Seidlberger, independent filmmakers based in Austria.

These Terms apply to all projects carried out jointly or individually under the Ease-Creative brand. Both parties act as independent contractors (EPUs) but may provide services together under shared creative direction.

1. Scope

These Terms govern all offers, productions, and services provided by Ease-Creative, whether commissioned jointly or individually. Any differing agreements must be confirmed in writing.

2. Offers & Estimates

All quantities and services listed in offers are approximate and may be adjusted according to actual effort.
Not included: travel costs, meals, accommodation, and other external expenses.
These will be charged separately based on actual cost.
For travel by private car, a mileage allowance of €0.50/km from Salzburg applies.

3. Booking & Cancellation

A booking becomes binding once confirmed verbally or in writing.
If cancelled by the client within 48 hours before the agreed shooting start, a cancellation fee of 40% of the quoted project volume may be charged.
For longer-term bookings, specific cancellation rules may apply as stated in the offer.

4. Payment Terms

Unless otherwise stated, 50% of the total project value is due upon confirmation (deposit), the remaining balance upon delivery of the first round of feedback-ready material or outputs.
Invoices are payable within 14 days of issue without deduction. Late payments may incur default interest according to Austrian law (§1333 ABGB).

5. Rights & Usage

All creative and production rights remain with the respective author(s) until full payment has been received.
Clients receive usage rights only for the purposes and platforms specified in the final agreement.
Any further use, edit, or transfer to third parties requires written approval.
Work or revisions beyond the agreed project scope may incur additional fees. These are communicated transparently at the beginning of each project and summarized again at final billing, rather than for every minor adjustment during production. Additional edit requests beyond the defined scope will be carried out as requested but billed separately.

6. Liability

Ease-Creative shall not be liable for minor negligence, unavoidable delays, or technical failures beyond reasonable control (e.g. weather, equipment malfunction).
Each contractor (Seitlinger, Seidlberger) carries individual business and liability insurance.

7. Data & Confidentiality

All data, materials, and project information are treated as confidential.
Project-related personal data will only be used for communication, billing, and production organization.
Ease-Creative reserves the right to involve cooperation partners or subcontractors under NDA agreements when deemed necessary for the project’s execution. For larger or cost-intensive productions, potential team extensions will be communicated with the client in advance whenever foreseeable.
All stored data and project materials are kept securely for a maximum of one year unless otherwise agreed. After this period, they are permanently and irreversibly deleted. Should clients require extended data retention, this must be explicitly requested in advance. No data, materials, or full project files will be shared with clients or third parties without prior written agreement before project start. Long-term storage or data handover is available exclusively through Ease-Creative for an additional fee, to ensure compliance with legal and contractual obligations.

8. Collective Structure

While Felix Seitlinger and Nickolaus Seidlberger operate independently, projects realized under Ease-Creative are coordinated collectively.
Each contractor issues their own invoice for their respective service share, unless otherwise agreed.

9. Legal Framework

All agreements are governed by Austrian law. The place of jurisdiction depends on the party addressed: Linz, Austria for Felix Seitlinger and Salzburg, Austria for Nickolaus Seidlberger.
In case of disputes, both parties aim for an amicable solution before legal proceedings.
